*Drone Footage:
If time and weather permits, I can fly it as long as the venue has no rules against it. I do not charge extra for drone shots, nor do I guarantee I will use them. I do use my drone for establishing shots of the venue. I do not think that a wedding film should consist of mostly drone footage. I will not fly my drone during the ceremony
We require that our start time is at least 1.5 hours before the bride puts her dress on. This will ensure that we will have enough time to capture details, fly my drone, and for filler/b-roll shots for your highlight & photo gallery.
Payment Terms: a non-refundable* ($5,000) service agreement (retainer) will be required to reserve your date.

Payment will be based on the price discussed prior to filling out this form. Completion of this form is an acceptance of the pricing emailed to you or given over the phone.
Force Majeure / Impossibility to Perform: The performance of this agreement by either party is subject to acts of God, war, restrictions of any governmental authority, strikes, terrorism, or other emergencies that make it illegal or impossible to substantially perform the Agreement, but in all cases excluding the financial condition of such Party. In such an event, prompt notice shall be given by the party canceling pursuant to this section. The party seeking cancellation of performance under this provision must exercise due diligence and take all reasonable steps to avoid, remove, and overcome the effect of the situation on the event.
Cancellation Clause: In the event of a wedding cancelation by Davey Hibler Productions, the client will either be refunded in full or Davey Hibler Productions will send an associate to film the wedding.
Cancellation-by-you Clause: Cancellation in part of the client will result in termination of services (this also applies to COVID-19 cancellations). The retainer is non-refundable and will not be issued back. Davey Hibler Productions will do the absolute best to find a date in which services can be rescheduled. Please see rescheduling below.
Rescheduling Clause: In the event of rescheduling or postponement, the client will be able to move the retainer to a new date later in the same calendar year or to the next calendar year with no additional fee. If I am not available for the new date, I will do my best to appoint you to a colleague of mine. As a reminder, the retainer is non-refundable as the date had originally been blocked off not allowing any other clients to book.
Model Release: The client hereby grants Davey Hibler Productions and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish video and photo of the client or in which the client may be included for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases Davey Hibler and its legal representatives and assigns from all claims and liability relating to said video/photos. It is understood that by being a guest at contracted client event, video will be taken of all in attendance. Select client video/photos may be used for business promotion, i.e. website, marketing media and sharing with other wedding vendors. Davey respects the intimacy that some clips may portray and will ask permission of the client before posting such content.
Copyrights: The videos produced by Davey Hibler are protected by Federal Copyright Law (all right reserved) and may not be reproduced in any manner without Davey’s explicit written permission. When video clips are provided via online storage to the client, the digital clips are the property of the client for personal use and for the purposes the reproduction and giving of video clips to friends and relatives. The client must obtain additional written permission from the compensate Davey Hibler prior to the client or its friend and relatives publishing or selling the videos for profit.
Miscellaneous: this agreement shall be binding upon the parties, their heirs, successors, assigns, and personal representatives. This agreement constitutes the entire understanding of the parties. It's terms can be modified only by a writing signed by both parties, except that the client may authorize expenses of revisions orally. Any dispute arising out of this agreement will be revolved by negotiation between the parties. This agreement shall be governed by the laws of the State of Nevada and courts of such state shall have executive jurisdiction and venue.
